Terms of Service

These terms are an agreement between you and [OPERATOR NAME / BUSINESS NAME], based in [CITY], India ("we", "us"), which runs LandGrab (the "Service"). By using the Service or booking an ad slot you agree to these terms. If you don’t agree, please don’t use the Service.

1. What the Service is

The Service is an advertising website. It shows a map on which advertisers can book ad slots displayed in connection with place names (for example a state, country, ocean or famous landmark). An ad consists of a name, an optional tagline, a colour, a category and an optional website link ("Ad").

Booking an ad slot buys advertising space on our website only. It does not give you any ownership of, claim to, licence over or other rights in any land, territory, building, landmark or place, or in its name or image. It gives you no stake in the Service. It is not a security, an investment or a game of chance.

2. No affiliation with places or landmarks

Ads are placed by independent advertisers. Neither the Service nor any advertiser is affiliated with, endorsed by, sponsored by or approved by any country, government, public authority, city, or the owner or operator of any landmark or building shown on the map, unless the Service says so expressly. You must not state or suggest such an affiliation or endorsement in your Ad unless it is true and you can prove it. Place names and our original landmark illustrations are used only to show where an Ad appears.

3. Eligibility

You must be at least 18 years old, or the age of majority where you live, to book an ad slot.

4. Booking ad slots and the ad chart

• Each place has a ranked ad chart. The price for each slot is shown before you pay: an open slot costs the place’s starting price, and an occupied slot costs 10% more than the Ad currently in it (at least $1 more).
• Ads are ranked by amount paid; equal amounts are ranked by booking time. Your final position is set when your payment completes. If another advertiser books a higher slot at the same moment, your Ad may land one or more slots lower than you chose.
• When a new Ad is booked at or above your position, your Ad moves down one slot. Ads outside the top 10 stay listed for that place but are not shown in its chart. You get no refund when your Ad moves down.
• Your Ad stays on the Service while the Service runs, subject to moderation (section 6). We don’t guarantee any number of views or visits.
• Payments are processed by a third-party payment provider. We never see or store your full card details.

5. Your Ad

You are responsible for your Ad and anything it links to. You confirm you have the right to use it, and you must not post an Ad that:

• is false or misleading, including suggesting an endorsement or affiliation that doesn’t exist;
• is hateful, harassing, threatening, sexually explicit or violent;
• contains anyone’s personal information without their consent;
• impersonates a person, brand, authority or organisation, or infringes trademarks or copyright;
• links to scams, malware, phishing, gambling, adult content or anything illegal;
• breaks any advertising or consumer law that applies to you or to us.

You give us a worldwide, non-exclusive, royalty-free licence to display, reproduce and share your Ad on the Service and in our promotional material, including social media posts about activity on the map, for as long as the Ad is listed.

6. Moderation

Anyone can report an Ad. We may hide or remove any Ad, at our discretion and without notice, if we believe it breaks these terms or the law, or if we receive a credible complaint from a rights holder or authority. No refund is given for Ads removed for breaking these terms.

7. Availability and changes

We try to keep the Service running, but it is provided "as is" and may be interrupted, changed or discontinued. We may change starting prices for future bookings and update these terms; changes apply from the date they are posted. If we shut the Service down permanently we will give at least 30 days’ notice on the site where reasonably possible.

8. Liability

To the extent the law allows, we are not liable for indirect or consequential losses. Our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot legally be limited.

9. Law and disputes

These terms are governed by the laws of India. Courts in [CITY], India have jurisdiction, without affecting any mandatory consumer rights you have where you live.
